Terms of Service - FeedPulse API
These Terms of Use (“Terms”) govern your access to and use of the FeedPulse API (“API”) provided by FeedPulse. (“FeedPulse”, “we”, or “us”). By accessing or using the API, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using the API.
1. API Usage and Restrictions
1.1. Authorized Use: The API is made available solely for the purpose of accessing and retrieving news content from external news sources. You agree to use the API in compliance with these Terms, applicable laws, and regulations.
1.2. API Key: To access the API, you must obtain an API key from FeedPulse. Your API key is personal to you, and you are responsible for maintaining its confidentiality. You must not share or disclose your API key to any third party.
1.3. Delays and Availability: The API is deployed on servers that may experience occasional delays or interruptions due to various factors, including server maintenance and high traffic. FeedPulse makes reasonable efforts to maintain optimal performance and availability, but we do not guarantee uninterrupted access to the API. You acknowledge that the delivery of news content may be subject to variable latency.
1.4. Use through RapidAPI: You understand that your use of the FeedPulse API through RapidAPI is subject to the terms, conditions, limitations, and obligations set forth by RapidAPI, as outlined in their Terms of Service.
2. Data Collection and Privacy
2.1. User Data: FeedPulse respects user privacy and is committed to protecting personal information. When using the API, FeedPulse does not collect, store, track, or analyze any personal data or identifiable information related to your API requests, including user-specific data or user behavior.
2.2. External News Sources: The news content retrieved through the API is sourced from external news providers. FeedPulse does not control the content provided by these sources and disclaims any responsibility for its accuracy, reliability, or legality. While we strive to ensure the quality and relevance of the news content, you acknowledge that FeedPulse cannot guarantee the accuracy, completeness, or timeliness of the information provided.
3. Intellectual Property
3.1. Ownership: FeedPulse retains all rights, title, and interest in and to the API, including any intellectual property rights associated with it. These Terms do not grant you any ownership rights to the API or its related materials.
3.2. License: Subject to your compliance with these Terms, FeedPulse grants you a limited, non-exclusive, non-transferable, revocable license to access and use the API solely for its intended purpose and in accordance with these Terms.
3.3. Restrictions: You must not modify, adapt, reverse engineer, decompile, or attempt to extract the source code of the API. You must not use the API in any way that violates third-party rights or is unlawful, harmful, or abusive. You acknowledge that the API and its related documentation contain proprietary information that is protected by copyright and other intellectual property laws.
4. Disclaimer of Warranty and Liability
4.1. API “AS IS”: The API is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. FeedPulse disclaims all warranties, including but not limited to fitness for a particular purpose, non-infringement, and accuracy of information retrieved through the API.
4.2. Limitation of Liability: FeedPulse shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising out of or in connection with your use of the API or any reliance on the news content retrieved through the API.
5. Modifications and Termination
5.1. Modifications: FeedPulse reserves the right to modify or discontinue the API or these Terms at any time without prior notice. Any changes to the Terms will be effective upon posting the updated version on the FeedPulse website.
5.2. Termination: FeedPulse may terminate your access to the API at any time for any reason, without liability.
6. Rate Limiting
6.1. FeedPulse may enforce rate limits on API usage to ensure fair and equitable access for all users. These rate limits are designed to prevent abuse, maintain system stability, and provide a consistent experience for all API consumers.
6.2. You agree to abide by any rate limits specified by FeedPulse and not attempt to circumvent or exceed these limits. If you require higher rate limits for your specific use case, you may contact FeedPulse to discuss the possibility of adjusting the limits.
7. Attribution
7.1. When using the API to display or distribute news content obtained from external sources, you must provide appropriate attribution to the original news sources. Attribution serves as an acknowledgment of the efforts and contributions of the news providers.
7.2. You agree to display the source of each news item prominently and include a link back to the original source whenever possible. The attribution should be displayed in a clear and visible manner, such as alongside the news title or snippet, and should accurately identify the news source.
8. Suspension or Termination
8.1. FeedPulse reserves the right to suspend or terminate your access to the API at any time and for any reason. This may occur if you violate these Terms of Use, engage in unauthorized or abusive behavior, or if your use of the API adversely impacts the operation of the service for other users.
8.2. In the event of suspension or termination, you must immediately cease all use of the API and delete any cached or stored data obtained through the API. You will no longer have access to the API functionalities, and any ongoing or future requests made using your API credentials will be denied.
9. Indemnification
9.1. You agree to indemnify and hold FeedPulse, its affiliates, partners, and employees harmless from any claims, losses, damages, liabilities, or expenses arising out of or in connection with your use of the API. This includes any violation of these Terms of Use, infringement of intellectual property rights, unauthorized access or use of the API, or any action or omission that causes harm to FeedPulse or any third party.
9.2. This indemnification obligation extends to the costs of defense, including reasonable legal fees, incurred by FeedPulse in relation to such claims.
10. Modifications to the API
10.1. FeedPulse reserves the right to modify, update, or discontinue any aspect of the API at its sole discretion. This includes adding, removing, or changing API endpoints, parameters, or response formats. These modifications may be made to improve functionality, address security concerns, comply with legal requirements, or enhance the overall user experience.
10.2. FeedPulse will make reasonable efforts to provide advance notice of any material changes to the API whenever possible. However, FeedPulse does not guarantee prior notification and reserves the right to implement immediate changes without prior notice.
11. External News Sources and Content Ownership
11.1. The news content provided through the FeedPulse API is sourced from external news providers. FeedPulse does not control or own the content retrieved through the API and disclaims any responsibility for its accuracy, legality, or reliability.
11.2. You understand and acknowledge that the ownership, intellectual property rights, and editorial control of the news content belong to the respective news providers. You must comply with any usage restrictions or licensing terms imposed by the news providers.
12. Governing Law and Jurisdiction
12.1. These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any legal action or proceeding arising out of or relating to these Terms shall be exclusively brought in the courts of the Republic of Kenya, and you consent to the personal jurisdiction of such courts.
13. Entire Agreement
13.1. These Terms of Use constitute the entire agreement between you and FeedPulse regarding your use of the API and supersede any prior agreements or understandings, whether oral or written.
13.2. In the event that any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
By using the FeedPulse API, you acknowledge that you have read, understood, and agree to abide by these Terms. If you are accepting these Terms on behalf of an organization, you represent that you have the authority to bind the organization to these Terms.
